    Instruct the Executive Director of Legal Services and Corporation Counsel, or his designate, to proceed in accordance with the instructions sought in Confidential Legal Report L-59-23; and

    That Council waive privilege on the of the clause in the closed session motion which states Council’s position on proposed Nelson Quarry Expansion; and

    That solicitor client privilege continue to apply for all purposes for the balance of the report L-59-23.

    Mayor Meed Ward read the clause pertaining to the waived solicitor-client privileged closed session motion:

    That the Executive Director of Legal Sevices and Corporation Counsel, or his designate, and retained legal council Rod Northey (Gowling WLG) be instructed to attend at the Ontario Land Tribunal to oppose the proposed Nelson quarry expansion and all applications made by Nelson for that purpose.

    Instruct the Executive Director of Legal Services and Corporation Counsel or his designative to proceed with the instructions sought in Confidential Legal Report L-60-23; and

    That Council waive privilege to the planning rationale for the applications at 720, 735 & 740 Oval Court & 5135 and 5155 Fairview Street contained in Appendix B of Report L-60-23; and

    That Council waive privilege on the City’s position to resolve the City’s issues in the appeal or proceed to a contested hearing; and

    That solicitor client privilege continue to apply for all purposes for the balance of the report L-60-23.

    Mayor Meed Ward confirmed that the City has accepted the Offer to Settle after solicitor-client privilege was waived.

    Receive and consider CS-17-23 as Burlington’s draft response to the Housing Affordability Task Force’s Recommendations inclusive of Appendices B and C, for purposes of preparing the Mayor’s response to the request from the Honourable Paul Calandra, Minister of Municipal Affairs and Housing; and

    Direct Community Planning and Government Relations staff to support the Mayor in preparation of the final response to the Minister prior to the October 16, 2023 deadline.
