The Development and Infrastructure Committee, in accordance with Section 34 of the Planning Act, as amended, held Public Meeting No.1 on January 10 to approve the proposed Zoning By-law amendment for 3011 Appleby Line. Having considered the oral and written comments received from staff and delegations, the Development and Infrastructure Committee received PB-15-17 for consideration.

Approve the application, to amend the zoning bylaw, submitted by Nikolas Papapetrou of Calloway REIT (Burlington Appleby Inc.) to permit a 1,202m2 expansion to the existing commercial retail development and to establish a new site specific parking requirement at 3011 Appleby Line; and

Enact and pass Zoning Bylaw 2020.XXX as attached as Appendix II of Planning and Building Department report PB-15-17 to amend the zoning for lands at 3011 Appleby Line; and

Deem that Bylaw 2020.XXX will conform to the Official Plan of the City of Burlington and that there are no applications to alter the Official Plan with respect to the subject lands.

Approve the application for variances to Sign By-law 34-2007 made by Sunset Neon Ltd. to permit the installation of a new ground sign and the relocation of an existing ground sign, which requires the following variances:

  1. Three (3) ground signs on a property, whereas a maximum of two (2) ground signs are permitted; and
  2. A distance of 27 metres between ground signs, whereas a minimum distance of 45 metres is required.

Subject to the following condition:

  1. The variance applies to the proposed ground sign and the proposed relocated ground sign only and is valid only for the duration of the existing uses on site.

Instruct the Legal Department to prepare the necessary documents; and

Authorize the Mayor and Clerk to sign any documents in connection with this matter.

Endorse the Halton Area Municipalities Joint Submission as contained in Appendix A to planning and building department report PB-07-17, and the comments contained in this report, in response to the Metrolinx Discussion Paper for the Next Regional Transportation Plan; and

Direct the City Clerk to forward the resolution of Council, subject to endorsement of the recommendations contained in PB-07-17, and any additional comments from Council, as well as staff report PB-07-17 with Appendices A to Metrolinx.
